Attorneys for Alec Baldwin have filed a motion to dismiss the manslaughter charge made against him in connection to the death of cinematographer Halyna Hutchins on the set of “Rust,” accusing special prosecutors for the New Mexico District Attorney of “abuse of the system.”
Baldwin was charged with one count of involuntary manslaughter for allegedly pointing a gun at Hutchins during rehearsal of a scene. The gun, which contained live ammunition unbeknownst to Baldwin, fired and fatally struck Hutchins and wounded director Joel Souza. Alec Baldwin will face a New Mexico jury this summer on involuntary manslaughter stemming from the 2021 fatal shooting of Rust cinematographer Halyna Hutchins.
As promised last week, Judge Mary Marlowe Sommer today set a date for the start of the multiple Emmy winner’s trial in the Land of Enchantment. Baldwin faces a prison sentence of 18 months to three years and around $5,000 in fines if found guilty.

Santa Fe, N.M. — The trial of “Rust” armorer Hannah Gutierrez Reed began Thursday with prosecutor Jason Lewis arguing that her “sloppy” and “unprofessional” conduct led to the death of the film’s cinematographer.
In his opening statement, Lewis argued that Gutierrez Reed had twice failed to properly check ammunition that she loaded into Alec Baldwin’s gun.
The cinematographer, Halyna Hutchins, was killed when Baldwin fired a live round during blocking for a scene in October 2021.
“The defendant treated the safety protocols as if they were optional rather than as if people’s lives counted on her doing her job correctly,” Lewis argued. “By failing to make those vital safety checks, the defendant acted negligently and without due caution. The decision she made that day contributed to Ms. Hutchins’ death.”
Gutierrez Reed is on trial for involuntary manslaughter and evidence tampering. She faces up to three years in prison if convicted.

Plans are for the joint venture, initially a U.S. project, to expand globally, providing full production services to the film and television industry from stage and studio rentals; rental equipment including lighting, grip and electric; postproduction services; graphics; and virtual production services.
Halmi told Deadline that Phygital has committed more than $50 million to acquire state-of-the-art lighting and grip equipment, and set aside 200,000 square feet of space to store it in across Great Point’s growing roster of studio locations. “Rust” has officially restarted production in Montana, a year and a half after the film’s cinematographer, Halyna Hutchins, was killed when a prop gun held by star Alec Baldwin discharged.
According to The New York Times‘ Julia Jacobs, who visited the movie’s set on Yellowstone Film Ranch, the production isn’t taking any chances this time around, as real guns are not allowed on the premises.
“I’ve said it, and I’m going to say it every single time: There are no weapons on set,” first assistant director Gerard Dinardi told the crew, according to the Times. “There is nothing that fires. There are a lot of facsimiles of weapons, from rubber to replicas.”

In new photos of the actor taken at Montana’s Yellowstone Film Ranch Friday, Baldwin is seen in character as Harland Rust, wearing a gray shirt with blood-stained cuffs, gray pants, a button-up black vest, high leather boots and an orange bandana around his neck.
The photos come after production on the Western officially resumed over the weekend. Rust Movie Productions, LLC announced the news in a press release on Friday, after criminal charges against Baldwin were dropped on Thursday.

“Rust” will resume production Thursday in Montana, with work beginning 18 months after actor Alec Baldwin fired a live round which killed cinematographer Halyna Hutchins while filming in New Mexico. Baldwin will return to the set just two weeks before the start of a court hearing in New Mexico to decide whether he will stand trial for a felony charge of involuntary manslaughter over the October 2021 incident.
