When Batman and Robin visit Penguin in his holding cell, he believes that he is being charged with "simulated murder". Batman corrects him, telling him that he is being held for violating the sanitary code. Since Penguin would have to be told the charge against him before being taken to his cell, this means that Batman and the police have changed the charge without telling him--a violation of Penguin's Miranda rights that Batman would never countenance.
