Throughout the episode, it is implied that Kevin Lee will be executed if he is convicted of murder in Australia. However, capital punishment in Australia was abolished in 1967.
When Commander Rabb and Lieutenant Roberts visit Seaman Dunsmore in the brig for the first time, the seaman is wearing the rank insignia of a Petty Officer, not that of a seaman, who should have no rank insignia.
Brumby tells Harm and Bud that a banana bender is a nickname for someone who grows bananas but it isn't. It is a nickname for people from the state of Queensland, who supposedly spend their time putting a curve into bananas, hence 'banana benders.'
Just before Harm, Brumby and Bud meet the prisoner, the text says that the place on screen is Garden Island brig, but what is shown is of Fort Denison on Pinchgut Island, which at the time of the show was a tourist attraction, and not a brig.
Non-Australians, English speakers or not, are often unaware that although 'Australia' and 'Australian' are pronounced with an 's' sound, the inhabitants of the country pronounce the shortened version 'Aussie' with a 'z' sound, as evidenced in the alternate colloquial spelling, 'Ozzie.' Petty Officer Kevin Lee, having lived in Australia so long, should know that but the first time Harm and Bud visit him at Long Bay prison, he pronounces it with an 's' sound. This is not the only instance of 'Aussie' being mispronounced in a JAG episode but possibly the only occasion where the speaker should know the correct pronunciation.
When the casket of the dead Australian sailor is being carried to the vehicle, there's a shot of Brumby leaning against a vehicle with his leg up. A rather unusual and disrespectful way for an officer to behave. He should stand at attention as a sign of respect.
