Criminal Sexual Act is the criminal charge for oral or anal sexual contact either by force or performed on a minor. There are three degrees of severity: criminal sexual act in the third degree is charged when the actor is over the age of 21 and the other person is less than 17 years old; it is a class E felony and carries a sentence of either five years probation or 1-4 years in prison. Criminal sexual act in the second degree is charged when the actor is aged 18 or older and the other is under the age of 15 or when a person cannot consent due to being mentally disabled or mentally incapacitated (intoxicated); it is a class D felony and carries a minimum sentence of two years in prison and a maximum of seven years. Criminal sexual act in the first degree is charged when: the act is done by force or when a person is physically incapacitated (unconscious or restrained), or when: the other person is under the age of 11 or when the actor is over the age of 18 and the other person is under the age of 13; it is a class B felony and carries a minimum sentence of five years in prison and a maximum of 25 years.
