In "The Fight" it's revealed that Marshall and his brothers use to have crazy fights. However, in The Sweet Taste of Liberty (2005), Marshall says "Oh Thank God, I've never been in a fight before." in the scene where he thinks a guy is hitting on Lily.
From the scene in the bar before the fight, it appears the people Doug fought went outside just to fight. This would make any civil suit or criminal prosecution almost pointless.
"The State" doesn't sue people on criminal matters. The State doesn't serve people with papers. The State arrests people, arraigns them in court and then everybody waits for trial.
