In July 1971, The First District Court of Appeals upheld a lower court decision dismissing a $554,500 damage suit against Avco Broadcasting brought by talk show host
Vivienne Della Chiesa. She had claimed that Avco breached her contract when it canceled her afternoon show in 1969, assigning her to other duties. Avco argued that Della Chiesa breached her own contract when she failed to appear as directed. Judge Frank M. Gusweiler dismissed the suit in September 1970 because he saw no cause for action.
