Herb's scandal is a reference to the George Michael scandal in the 90s in which he was discovered having sex with a man in a park bathroom.
References in the 80s and 90s flashbacks include Flashdance (1983), the shoe brand L.A. Gera, the George Orwell book 1984 (which ironically wasn't that much part of 80s culture), Ronald Reagan's love of jelly beans, the Coke-Pepsi wars, "Bill's Sax Shop" (which references how Clinton charmed audiences on Arsenio-Hall), Planet Hard Rock (referencing two Hollywood ventures into entertainment at the time), and Nirvana's album "Nevermind" (which is called "Nevermore").
At the protest after Herb's arrest, one of the protesters is holding a sign that simply says "C'mon!" This was one of Will Arnett's catchphrases on Arrested Development (2003).
