Paul Thompson, a prosecutor in the Los Angeles County D.A.’s sex crimes unit, is leading the case against Harvey Weinstein, which got underway on Monday morning.
But Thompson was not initially assigned to the case. The case was originally given to Lowrie Mendoza, a deputy district attorney who has prosecuted sex crimes for the last 14 years.
She and her boss, Christina Buckley, were both removed from the case in 2019 out of concern that they had been told of a confidential email between Weinstein and his defense lawyer, according to court declarations reviewed by Variety. An LAPD detective, Javier Vargas, was also removed from the case because he read the attorney-client email, according to the declarations.
Removing them would eliminate the possibility that an appeals court would later overturn a conviction due to that issue.

A week after Heather Locklear was underwent a psychological evaluation after threatening to shoot herself, the actress was arrested for attacking a police officer and an Emt who responded to a disturbance call.
A family member of Locklear’s called 911 on Sunday night while Locklear was “heavily intoxicated,” according to TMZ. When police arrived, she reportedly punched an officer attempting to separate her from family. Locklear then kicked an EMT who was putting her on a gurney.
Locklear’s name is listed on the Ventura County Sheriff’s Office police log. Authorities did not immediately return People’s request for comment.

Fears for the health of troubled star Lindsay Lohan are mounting after she was spotted enjoying several rounds of cocktails during a night out this weekend (begs19Apr08).
The Mean Girls actress recently pledged to stay sober after a spell in rehab last year, following two Dui incidents which resulted in a brief stint in jail.
But Lohan's sobriety has been called into question after frequenting several New York nightclubs with her Dj friend Samantha Ronson.
The 21-year-old arrived at Times Square's Hawaiian Tropic Zone on Saturday with Ronson, who spun tunes for the club from midnight until 4am.
Lohan, meanwhile, sat at a table behind her pal's booth in the second floor V.I.P. section, where she was seen smoking cigarettes, chatting to friends and reportedly sipping Grey Goose vodka and Red Bull (energy drink) cocktails.
Lohan finally emerged from the building at 4.15am after Ronson's gig finished. Last weekend (begs12Apr08), Lohan accompanied the Dj to gigs at three different Los Angeles venues.
Lohan previously suffered relapses while in Italy on New Year's Eve, and again in New York in January.

Mel Gibson has been praised for his progress by a California judge following his arrest for driving under the influence last year. The Signs star, 51, was arrested for drunk driving on July 28, 2006 in Malibu, when he proceeded to verbally abuse arresting officer James Mee with anti-Semitic remarks. In August 2006, Gibson pleaded no contest to misdemeanor drunk driving charges and was sentenced to three years probation, a 90 day alcohol-abuse program and 12 months of Alcoholic Anonymous meetings. Gibson's lawyer Blair Berk attended a Malibu court on Thursday where a judge announced Gibson was free to attend AA meetings on a voluntary basis, Tmz.com reports. The actor/director is scheduled to appear in court for a further hearing on February 15.

Lindsay Lohan's lawyer have angrily blasted the police for "selling stories", after the actress' toxicology tests following her drink driving arrest were leaked online. A report published on entertainment site Tmz.com shows Lohan had cocaine and "nearly twice the legal limit" of alcohol in her blood when she crashed her Mercedes in Beverly Hills, California on May 26. Following her arrest, Lohan checked into Promises rehabilitation centre in Malibu, California, where she currently is still seeking treatment. After police sources told Tmz.com the alleged results of the toxicology tests, the I Know Who Killed Me star's attorney issued an angry comment. Lawyer Blair Berk tells the New York Daily News, "This is an ongoing investigation. It is shameful that law enforcement would be selling stories, let alone unverified ones." Rapper Eve has pleaded guilty to driving under the influence (DUI) following an incident in April when she crashed her car in Los Angeles. The 28-year-old - real name Eve Jeffers - was not present in Los Angeles County Superior Court for Thursday's hearing. Her lawyer Blair Berk acted on her behalf. Under the terms of her guilty plea, Eve must wear an alcohol monitoring ankle bracelet for 45 days and pay $1,400 in fines. She must also enroll in the first offender alcohol education program and serve 36 months of "informal" probation. On July 20, her attorney must prove Eve is wearing the ankle bracelet and has joined the alcohol education program, reports website TMZ.com.
